US PowerBall Bets are placed on the result of the relevant draw of the American “Powerball” lottery as organised by the Multi-State Lottery Association (www.musl.com) (“MUSL”).

The “Powerball” draw consists of a random draw of five Numbers from 1 to 69, and a supplementary random draw of a Powerball number from 1 to 26. The Player of a Bet picks five numbers and one number accordingly.

Draws are usually held every Wednesday and Saturday at 23:00 Tallahassee time (Eastern Time).

The Powerplay option is not available through the Website.

The deadline for participating in a draw is determined for each respective draw, and will be posted on the Website.

Only one Prize Category can be won per Bet, which will be the highest of the available Prize Categories achieved by, and relevant to, that Bet.

The Winnings payable in respect of each Winning Bet in Prize Categories 3 to 9 will correspond to the winnings announced by MUSL for a Powerball winning ticket.

The Winnings payable in respect of each Winning Bet in Prize Category 1 and 2 will depend on (a) the number of MUSL winning tickets in the relevant Prize Category plus the number of Network Winning Bets in the relevant Prize Category (“WINNERS”), and (b) the aggregate Pay Out by MUSL in the relevant Prize Category (“FUND”). The Winnings will then be calculated as FUND divided by WINNERS thus:

If MUSL has not announced a Pay Out for Category 1 for the relevant draw, the Pay Out payable in respect of each Winning Bet in Category 1 will be calculated on the basis of the official advertised Jackpot amount for that Lotto Draw or the official reported Category 1 prize pool (if any) – the latter taking precedence.

Pay Outs in any particular Prize Category other than the jackpot are calculated on the basis of the amount of aggregate stakes published by MUSL as well as the distribution to that Prize Category or on the basis of the value published by MUSL for that Prize Category of the relevant draw of the underlying lottery.

In the event of conflict between language translations English shall take precedence.

Lump sum:

In the USA, for Mega Millions and Powerball the jackpot sum is paid as an annuity, however, there is a choice to take the full winning sum as a one-off payment subject to a percentage deduction for accelerated receipt. In circumstances of a jackpot win, we will pay the full winning sum as a one-off payment subject to the same deduction for accelerated receipt. The rate at which the deduction will be applied will be as per the current rules of the lottery concerned for the time being.

Taxes:

Winnings in certain Prize Categories are paid free of taxes, others (in particular the Jackpot are subject to various taxes including Federal Income Tax and local State / City Taxes depending on the state of origin (we originate in New York for these purposes). We will make any payments subject to the same deductions as applied by the various US tax authorities. The amounts deducted are dependent on the thresholds over which tax is applied and rates of tax applied from time to time by the US Inland Revenue Service and other authorities levying relevant taxes.
